This action was brought by respondent to recover from the appellants the loss sustained in three shipments of limestone consigned to respondent at Chester, South Carolina, by Campbell Limestone Company, from Gaffney, in this State; and for the penalty (Code, Section 7165) for failure to adjust and pay the claims filed for such losses within the period fixed by the statute.
