The complaint alleges that on or about the day of June, 1908, the plaintiff and the defendant agreed to negotiate for an option upon, and also for the purchase of, a certain piece of property situated in the city of New Haven, on Water Street, known as the Halstead & Harmount property, which at that time was owned by the Middletown Savings Bank, of Middletown, Connecticut; title was to be taken in the name of the defendant, and the property was to be resold for the benefit of the plaintiff and the defendant, or any other partners in the transaction.
