Reversing.

The case involves the presumption of death through absence and being unheard of for seven years.

The life of Watson E. Caudill was insured by the Commonwealth Life Insurance Company in the sum of $5,000. The premiums paid kept the policy in force until December 24, 1924. The petition of his father, appointed as the administrator of his estate, alleges that he died October 27, 1924, by accidental means.
