In an action for libel and for violation of sections 50 and 51 of the Civil Bights Law, Special Term denied a motion to dismiss the complaint for legal insufficiency. Defendants appeal.
Defendants published an article in a monthly magazine called “ Pageant ”. The article is annexed to the complaint. It was entitled “ Let’s Abolish Boxing ” and was written about the title subject by the defendant Cannon, a sports writer.
