ROGERS, Justice.

The relator, Henry Landry, on behalf of his minor daughter, Beatrice Landry, brought suit for damages against the New Orleans Public Service, Inc., and the city of New Orleans for personal injuries suffered by Miss Landry in an automobile accident. At the time of the accident, which occurred on the night of April 21, 1927, relator’s daughter was the -guest of Joseph Gumbel, who was driving an automobile owned by his sister Mrs. Oora G. Moses.
