—Judgment unanimously modified on the law and as modified affirmed in accordance with the following Memorandum: Defendant appeals from a judgment convicting him after a jury trial of murder in the second degree (Penal Law § 125.25 [1]) and criminal possession of a weapon in the third degree (Penal Law § 265.02 [1]) in connection with the stabbing death of an acquaintance. Defendant was also convicted of assault in the second degree (Penal Law § 120.05 [6]) with respect to injuries sustained by a person who attempted to stop defendant from stabbing the victim.
