STATEMENT OF THE CASE

In a six count complaint, the plaintiff, National Enquirer, Inc. (“Enquirer”) has brought this action against News Group Newspapers, Ltd. (“News Group”), the defendant, essentially alleging the wrongful appropriation and use of photographic pictures of the wedding of actress Joan Collins and Peter Holm.
