Appeal from a judgment of the County Court of Tioga County (Siedlecki, J.), rendered December 11, 1984, upon a verdict convicting defendant of the crime of grand larceny in the third degree.

On October 4, 1983 between 9:00 p.m., and 9:30 p.m., while Delbert Huckle, Jr., was leaving his place of business in the Village of Waverly, Tioga County, to go to a nearby grocery store, he observed two individuals coming from behind an apartment building where Larry Newton lived.
