The defendant was tried on an indictment which contained two counts. The first count charged him, under section 145 of the Criminal Code, with breaking and entering the treasurer’s office, in the court house at Barnwell, in the night time, with intent to steal. The second count charged him, under section 163 of the Criminal Code, with entering the said office with intent to steal. The testimony on the part of the State tended to show that defendant broke and entered said office, in the day time, with intent to steal.
