Aleen, J.: It is only necessary to consider a single question presented by the record before us. The plaintiff's claim rests entirely'on the chattel mortgage given by Chalfant to Stanford. It is not claimed that the plaintiff ever had possession of the property either before or after its seizure by the marshal. There is no direct testimony in the record as to the transaction between Chalfant and Stanford.
