Appeal from conviction of second degree murder. Appellant does not claim insufficiency of the evidence but relies upon errors in rulings upon evidence and in giving or refusing instructions.

About 11 p. m., on January 24, 1960, deceased, Dr. Quattelbaum, with three companions (Mrs. Beverly Burton, Mr. Burton and Virginia Patridge), was at the Baby Doll Bar in San Pedro, drinking some beer and playing a bowling machine.
