OPINION

OLIVER, Judge.

Ira Leighton, the plaintiff in error and petitioner below, appeals to this Court from the judgment of the Cir cuit Court of Lawrence County which dismissed his petition for the writ of habeas corpus following an evidentiary hearing. After an earlier judgment entered by the Lawrence County Circuit Judge was reversed and remanded by the Supreme Court of Tennessee, the Chief Justice designated Honorable J. Fred Bibb, retired Criminal Judge, to re-try the cause and it is from his judgment that the petitioner now appeals.
