On July 17, 1974, Harold Leamon Mozingo was sentenced to a term of life imprisonment, to be served in federal prison, for conspiracy to kidnap and to highjack a truck. He was sentenced by the United States Court for the Eastern District of North Carolina.

Prior to this trial on January 23, 1974, the appellant pleaded guilty to a charge of murder in the trial court of the State of South Carolina. Although the reasons are not clear, the appellant was released to the federal authorities in North Carolina to be tried on the conspiracy claim.
