Appeal from an order of the Supreme Court (McCarthy, J.), entered February 8, 2006 in Albany County, which denied defendant’s motion for summary judgment dismissing the complaint.
Defendant1 owns property at 2120 Western Avenue in the Town of Guilderland, Albany County, the site of Regency Park Apartments (hereinafter the complex). The complex’s employees are responsible for ground maintenance, including snow and ice removal. Plaintiff is a resident and lessee at the complex.
