Appellant Joseph Tovar appeals from a summary judgment in a declaratory judgment action brought by the Board of Trustees of Somerset Independent School District (the Board) declaring that Tovar had vacated his office as a trustee of the Board by failing to maintain his residence within District 1, the district he represented, and that the Board had the authority to declare the position vacant.
