Although these cases were tried- separately in the criminal district court, they may be considered as one case because the same question is presented in both cases. The question is whether the statute which the defendants stand convicted of violating contravenes the Fourteenth Amendment, and particularly the equal protection clause in the Fourteenth Amendment, of the Constitution of the United States.
