Loring, Justice.
This is an action based on a promissory note for $500 dated September 1, 1936, payable to one Vie A. Baxter or order, and signed by defendant. The blank spaces provided for the insertion of the maturity elate and interest rate were not filled in. The jury found for defendant, and plaintiffs appeal from the order of the trial court denying their alternative motion for judgment or a new trial.
