Appellee sued the appellant, railroad company, to recover damages for personal injuries in the sum of $2,500, and for loss on account of inability to practice for two months his occupation as a physician, $650. Plaintiff alleged that he became a passenger from Athens to Larue February 22, 1910, and that the railroad company negligently failed to stop its train at Larue, but after passing the depot the train appeared to plaintiff to have almost stopped, and, appellee supposing such slowing up was an invitation to alight, he attempted to alight, and was thrown violently to the ground,…
