The defendant appeals from a conviction for possession of heroin with intent to distribute.

The defendant was arrested on April 6, 1973, as a result of a raid by the police at a residence at 3611 Seward Street in Omaha, Nebraska. When the police entered the house the defendant was in the living room crouching down near a davenport. There were other persons in the house but no other person was ini the living room except the defendant.
