Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Albany County) to review a determination of the New York State Racing and Wagering Board (Division of Harness Racing) which affirmed the action of the judges at Batavia Raceway in suspending petitioner’s license to drive harness horses for five racing days and ordered the forfeiture of a bond posted by petitioner in connection with the administrative proceeding conducted herein.
