GAGLIARDI, District Judge.

This is an action by plaintiff North American Phillips Corporation (“Norelco”) against defendant Emery Air Freight Corporation (“Emery”) to recover damages in the sum of $114,003.00. This sum represents the value of a truckload of plaintiff’s Norelco Speed Shavers which were hijacked while in the defendant’s possession. The case was removed to this court from the Supreme Court of the State of New York on the ground that the rights and liabilities of the parties are determined by the Federal Aviation Act of 1958, 49 U.S.C. § 1301 et seq.
