Plaintiff alleges that in the month of July, 1933, he was employed as attorney at law by Jesse W. DeVilbliss, Roy DeVilbliss and Herbert DeVilbliss, through the last named acting for himself and on behalf of the other two, his father and brother, respectively, to protect their titles to and interest in the South half (S.%) of Section 11, Township 9, S.
