The appellant, Freddie Joe Church, was convicted of the crime of murder in the first degree of Robert Lee Stickler. The case is before this Court on an appeal from a final order of the Circuit Court of Wyoming County, entered on August 9, 1979, sentencing the defendant to life without mercy in the West Virginia State Penitentiary at Mounds-ville, and denying the defendant’s motion to set aside the verdict and award him a new trial.
