Defendant in error, J. B. Pollard, by proper proceedings, sought to set aside an award made under the Workmen’s Compensation Act by the Industrial Accident Board, and to recover compensation for injuries alleged to have been sustained by him on October 1, 1925, while in the employ of the Silvers Box Corporation at Dallas, Tex. The case was submitted to a jury on special issues.
