Error to the Oyer and Terminer of Clearfield county. John Oathcart was indicted, convicted, and sentenced to death, for the murder of his wife, in the Court of Oyer and Terminer of Clearfield county. The indictment contained but one count, and was drawn up in accordance with the provisions of the revised criminal code of 1860. The trial and conviction took place at September Term, 1860, followed by motions for a new trial and in arrest of judgment.
