The facts are stipulated as follows:

“ On November 1, 1939, The American Bed Cross, Albany County Chapter, entered into a contract with Katherine W. Lane for the purchase of a parcel of property known as 385 State street, Albany, N. Y. The purchase price for the property was $12,000, payable as follows: $1,000 on delivery of deed and the balance of $11,000 by payments of $500 on the 1st day of January and July in each year, beginning July 1, 1940.
