Schweitzer, J.), entered March 15, 2013, which granted plaintiffs’ motion for partial summary judgment dismissing defendant’s counterclaim for delay damages and for an order dissolving the injunction bond posted by plaintiffs, modified, on the law, to deny that part of the motion seeking to dissolve the bond, and to reinstate the bond, and otherwise affirmed, without costs.
