delivered the opinion of the court on suggestion of error.
The judgment of the court below was affirmed on a former day of the present term, and counsel for the appellant now suggest that there are two errors therein, one of which was called to the attention of the court when the case was submitted, but the other was not, and is now presented for the first time.
