In October, 1835, H. W. Schroeppel being the owner' of two hundred and fifty acres of land, situate in Oswego county, contracted with the plaintiff to sell and convey to him a part of it containing sixty acres, at the price of $465; fifty dollars of the purchase price to be paid down, and the residue at or before the expiration of ten years with annual interest.
