The injury complained of was occasioned *153by the construction of the Midland Railway in one of the streets of the city of Aspen. The suit was brought by Mrs. Trevarthen, in the district court of Pitkin county. The company demurred to the complaint, and when the demurrer was overruled declined to plead further, and prosecuted this appeal from the final judgment. When it was entered evidence was introduced to show the extent and character of the damages which had been sustained by the building of the road, and this is set out in the record.
