I can not concur in the conclusion reached in the prevailing opinion, and deem it my duty to express my views of the law in so far as they differ from those of my associates.

I concur in that part of the opinion which holds that ap*173pellants are not entitled to liave judgment in tlieir favor on the answers-to interrogatories notwithstanding the general verdict, but I clo not concur with the reasoning by which that conclusion is reached.
