The appellant, attorney Kenneth B. Mason, appeals through counsel a June 21, 2004, decision of the Board of Veterans’ Appeals (Board) that determined that the “fee specified in the fee agreement between [the appellant-attorney] and the veteran is excessive and unreasonable in that it includes both an [Equal Access to Justice Act (EAJA), 28 U.S.C. § 2412(d) ] award plus a contingency fee for work performed before the Court, Board and VA on the same claim.” Record (R.) at 4.
