WHITING, J.

Tbe defendant was convicted in the Eifth Circuit Court of the offense of “having opium unlawfully in his possession.”

Exceptions taken:

1. In the course of the trial, the prosecution propounded the following question to a witness, Meeawa: “Do you know whether he (the defendant) said anything to the purser of the steamer?” Objected to on the ground that the same was immaterial and irrelevant.
