HOLMES, District Judge.

The referee denied the petition of the trustee in bankruptcy to require the Merchants’ National Bank & Trust Company, of Vicksburg, Miss., to pay over to him the sum of $328.18, charged to the cheeking account of the bankrupts on the books of the bank, and ex-edited on a note due it by the bankrupts after the involuntary petition was filed but before adjudication. The trustee filed a petition to review the order of the referee, and the ease is here for detexmination upon facts free from dispute.
