The defendant, Columbia George, was jointly indicted with Toy Toy, but separately tried and convicted of the crime of murder in the first degree', committed on the United States Indian Reservation in Umatilla County, Oregon, and this appeal is from the judgment rendered in pursuance thereof. Both defendants are Indians of the Umatilla tribe, allottees of the reservation lands, and resided thereon at the time of the commission of the offense.
