Tbe plaintiff, Craft, was tbe owner of an undivided four-fifths interest in a lot in Wilmington, and bis sister, Mrs. Mathis, was tbe owner of tbe other fifth of said lot. Plaintiff borrowed $900 of tbe defendant, to secure tbe payment of which be mortgaged to tbe defendant corporation bis four-fifths interest in said lot. After tbe date of tbe mortgage of plaintiff to defendant, Mrs. Mathis commenced a proceeding in tbe Superior Court of New Hanover County before tbe Clerk for partition, in which she alleged that said lot could not be actually divided without great damage to tbe parties…
