delivered the opinion op the court:

The only question in this case is as to the right to a horse, for which the appellee obtained a judgment against the appellant.

In April, 1858, the qppellee, Mrs. Gooch, sued her husband, C. Gooch, for a divorce, and alleged in her petition that he had possession of a horse and other property, which had been given to her by her father, and that he was about to dispose thereof to defraud her of her right thereto, and prayed that he might be restrained therefrom, and that said property might be adjudged to her.
