This suit was instituted in the district court of Cameron county, Tex., by W. L. Parker, appellee, against A. E. Rankin, appellant, on November 9, 1926. Appellant thereafter filed his original answer in the form of a general demurrer and general denial. On January 2, 1927, appellee filed his first amended original petition, and on January 18, 1927, appellant filed his first amended answer and a general demurrer and general denial and special answer and cross-action, and on the day of .trial amended said answer by interlineation, admitting that title failed to 14.26 acres of 68 acres of land…
