Appeal from an order of the Supreme Court (Canfield, J.), entered July 31, 1997 in Albany County, which granted defendants’ motion for summary judgment dismissing the complaint.

This appeal requires us to ascertain whether plaintiff has stated, or in fact possesses, any cognizable cause of action in consequence of being discharged from his employment for complying with a summons for jury duty.
