The report of the committee contains an *453elaborate statement of facts, many of which are immaterial in themselves, but important only as being evidential of other facts which are material; there is also a reference to a large mass of documentary evidence used_on the trial, all of which is simply evidence tending to prove the material facts in controversy. In this connection we may add that many of the questions discussed in the able and exhaustive arguments to which we listened, are questions of fact.
