In an action to recover damages for personal injuries, the plaintiff appeals from an order of the Supreme Court, Nassau County (Palmieri, J.), dated July 25, 2001, which granted the defendant’s motion pursuant to CPLR 3216 to strike the note of issue and dismiss the complaint.

Ordered that the order is affirmed, with costs.

In a certification order dated April 5, 2000, the Supreme Court, sua sponte, directed the plaintiff to serve and file a note of issue within 90 days, and warned that the failure to comply may serve as a basis for dismissal pursuant to CPLR 3216. Counsel for both parties…
