The plaintiff in error is the administratrix of the estate of Peter Fomakis, deceased. Her right, if any, arises from the following facts. On June 1, 1921, the intestate, while employed by defendant in error as a miner of coal, suffered an injury which resulted in permanent total disability, for *456which he became entitled to receive compensation under the Workmen’s Compensation Act (Secs. 4315-4348, C.
