This is an appeal from a judgment of the County Court of Broome County, rendered March 30, 1967, upon a jury verdict convicting defendant of the crimes of rape in the first degree, assault in the second degree and burglary in the second degree.

The victim of the crimes was a 28-year-old housewife and mother of an eight-month infant. At approximately 11:00 a.m. on a weekday morning, she heard a knock on her hack door and answering it, she saw the defendant who was seeking *226directions.
