On December 31, 1921, appellant killed appellee’s Holstein bull on one of its crossings at about a mile west of the city of Orange, by striking it with one of its passenger trains, which was being operated at a speed of about 40 miles per hour. At that crossing a public road runs east and west parallel with the railroad track and at a distance of about 60 feet from it.
