Richard Griffin was convicted in the United States District Court for the Southern District of Ohio, Western Division on a two-count indictment. Count one charged that on or about March 24, 1965, the appellant Griffin had in his possession a U. S. Treasury check in the amount of $806.75, knowing said check to have been stolen. Count two charged that on or about March 24, 1965, the appellant Griffin uttered and published as true as U. S.
