This as an article 78 proceeding in the nature of certiorari to review and reverse the determination made by the Commissioner of the Department of Social Services of Westchester County and by the Commissioner of Social Services of the State of New York, wherein all medical assistance to the petitioner is to be terminated. The basis for the decision to discontinue medical aid to the petitioner is that she was a distributee of her deceased sister’s estate and as such was entitled to receive an intestate share thereof valued at approximately $8,500 which she renounced in favor of her daughter.…
